Terms of Service

1. Scope of Engineering Services
MarmorSlab is a professional portfolio brand owned and operated by Agustin Marmor ("the Developer"). These terms govern the custom web design, front-end engineering, and deployment infrastructure services provided by the Developer. Each project is governed by a separate Statement of Work (SOW).
2. Client Responsibilities & Assets
Clients are responsible for providing all necessary brand assets, text copy, and high-resolution imagery. MarmorSlab is not liable for project delays resulting from incomplete or late submission of these materials.
3. Hosting & Third-Party Platforms
MarmorSlab utilizes industry-leading infrastructure providers (e.g., Vercel, Name.com). While we handle initial configuration, the client is responsible for maintaining their own accounts and associated third-party fees. MarmorSlab is not liable for downtime or data loss caused by these providers.
4. Intellectual Property & Code Ownership
Full ownership of the custom frontend code and design assets is transferred to the client upon receipt of final payment. MarmorSlab retains the right to display the project in our professional portfolio and use non-proprietary engineering patterns developed during the build.
5. Acceptance & Bug-Fix Window
Upon deployment to the production environment, the client has 14 calendar days to report any technical bugs or deviations from the original SOW. After this period, the project is considered "Accepted" and any further modifications will be billed at our standard hourly engineering rate.
6. Limitation of Liability
In no event shall the Developer (Agustin Marmor) be liable for any indirect, incidental, or consequential damages (including loss of business profits) arising from the use of the websites engineered under the MarmorSlab brand.
7. Payment & Refund Policy
A non-refundable deposit of 50% is required to initiate any project. The remaining balance is due upon final delivery. All payments are securely processed through Stripe, our third-party payment processor. By making a payment, you agree to Stripe's Terms of Service and Privacy Policy. Once development work has commenced, the initial deposit is non-refundable. If the client cancels the project after design approval or during active development, they will be billed at our standard hourly rate for all work completed beyond the deposit. Refunds are not provided for completed work that meets the agreed-upon SOW specifications. Refunds, if applicable, will be processed through Stripe within 5-10 business days.
8. Confidentiality
MarmorSlab agrees to maintain the confidentiality of any proprietary business information, trade secrets, or sensitive data shared during the course of the project. Client information will not be disclosed to third parties except as required by law or with explicit client consent. Both parties agree to handle all confidential materials with appropriate care.
9. Warranties & Disclaimers
All websites are delivered 'as-is' upon final acceptance. MarmorSlab makes no warranties, express or implied, including but not limited to warranties of merchantability or fitness for a particular purpose. While we engineer sites to industry standards, we cannot guarantee uninterrupted operation or absolute security due to the inherent nature of internet infrastructure.
10. Force Majeure
MarmorSlab shall not be liable for any failure or delay in performance due to circumstances beyond reasonable control, including but not limited to acts of God, natural disasters, pandemics, government actions, internet service disruptions, or third-party platform outages. In such events, project timelines may be extended accordingly.
11. Severability
If any provision of these Terms of Service is found to be unenforceable or invalid under applicable law, such provision shall be modified to reflect the parties' intention or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
12. Governing Law & Jurisdiction
These Terms of Service shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law principles. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts located in Osceola County, Florida.

14. Modifications to Terms
MarmorSlab reserves the right to modify these Terms of Service at any time. Changes will become effective immediately upon being posted to this page. It is the client's responsibility to review these terms periodically to stay informed of updates.
